Guarantee of sale of display products
FIRST. PURPOSE OF THE DOCUMENT
The purpose of this display product warranty policy is to establish, regulate and detail the terms, conditions and limitations of the warranty applicable to products marketed as ‘display products’ by the seller, as well as the rights, obligations and duties corresponding to the buyer, in accordance with the provisions of current Spanish consumer protection legislation.
SECOND. DEFINITION OF DISPLAY PRODUCTS
For the purposes of this contract, a display product shall be understood to be an item that has been used solely and exclusively for non-functional display purposes, having been installed or presented at trade fairs, showrooms, permanent exhibitions, trade shows or authorised points of sale, as well as in temporary distribution spaces, without having been installed, connected to the water or electricity supply, or used for its intended purpose in any case.
THIRD. AESTHETIC CONDITION AND PRIOR NOTIFICATION
Due to the nature of this type of product, they may have some imperfections, scratches or visible marks resulting from handling during the public display process. The customer shall have the right to request specific information about the aesthetic condition of the item before purchasing it. To do so, they may submit a written request, and, where appropriate, they will be sent actual, current photographs of the specific product they wish to purchase, so that they can make an informed and transparent decision.
FOURTH. FUNCTIONAL CONDITION OF THE PRODUCT
All display products offered to the public have undergone technical and quality review, testing and control processes to ensure that they are in perfect functional, operational and technical condition. Products with any aesthetic imperfections will be disclosed to the customer in advance, and their operational condition will be fully functional at the time of delivery. Under no circumstances will the existence of cosmetic defects, superficial marks or signs of tampering affect the technical functionality of the product, which is considered to have been verified in accordance with the parameters established by the original manufacturer.
FIFTH. CONDITIONS OF SALE AND EXPRESS ACCEPTANCE
The price of display products will be lower than that of new products. As a necessary condition for making the purchase, the customer must expressly accept – by electronic means, digital signature or equivalent express consent – the conditions of sale, use and warranty described in this document, expressly waiving any expectation derived from the ‘new’ condition of a first-use item. Likewise, it is hereby stated that the buyer declares that they are aware of and accept: the display nature of the product, its possible visible aesthetic condition and the installation conditions necessary for its correct functioning.
SIXTH. PRIOR INFORMATION AND OBLIGATIONS OF THE SELLER
In compliance with Article 116 of Royal Legislative Decree 1/2007, of 16 November, the seller undertakes to provide clear, complete, truthful, understandable and detailed information about the product being sold. This information shall include, among other aspects: technical description, documented aesthetic condition, applicable limitations or particularities, specific conditions of installation and use.
SEVENTH. LEGAL WARRANTY AND TIME FRAME
In accordance with the provisions of Article 123.7 of RDL 1/2007, display products are legally considered to be equivalent to used or second-hand goods, and therefore the legal warranty is established for a period of 1 year (12 months) from the date of delivery documented by invoice, delivery note or proof of purchase.
EIGHTH. WARRANTY COVERAGE
During this period, the customer will be covered for: Internal or structural faults. Electrical, electronic or mechanical defects. Functional faults that prevent the normal use of the product according to its original technical specifications. The warranty includes, as appropriate, repair, replacement or proportional refund of the amount paid, at the seller’s discretion and after the corresponding technical analysis.
NINTH. SPECIFIC WARRANTY EXCLUSIONS
The following are expressly excluded from coverage: 1. Visible aesthetic imperfections previously described and accepted by the customer. 2. Damage resulting from incorrect installation, negligent handling or misuse. 3. Normal wear and tear, such as rubber parts, bumpers, seals, seats or batteries. 4. Interventions not authorised by the official technical service or the use of non-original parts. 5. Defects due to insufficient pressure or flow: The customer is informed that the correct functioning of certain products (such as electronic toilets or hydraulic devices) requires a minimum pressure of 2.56 bar and a flow rate equal to or greater than 7 litres in 15 seconds in the case of Japanese toilets without a water tank with floor outlet, and a minimum pressure of 2.5 bar and a flow rate equal to or greater than 8 litres in 15 seconds for wall outlets. In installations where other water consumption points are used simultaneously, it is the sole responsibility of the customer to ensure that the pressure and flow rate are not reduced by other simultaneous demands. The seller or manufacturer shall not be liable for any malfunction due to these conditions.
TENTH. RIGHT OF REVIEW AND WITHDRAWAL
The purchaser has 15 calendar days from the date of delivery to verify the aesthetic and functional condition of the product. If an unreported defect or malfunction is detected, the purchaser may contact customer service to request collection and technical diagnosis. This right is conditional upon the cumulative fulfilment of the following requirements: the product has not been installed, has not been connected to the water or electricity supply, has not been used or tampered with, and the original packaging is intact. If any of these requirements are not met, the right of withdrawal will be automatically invalidated, and the product will be considered non-returnable.
ELEVENTH. COMPLAINT PROCEDURE
Any complaint must be made in writing by email or using the form provided, attaching supporting documentation (photographs, video, invoice, description of the fault). Once the notification has been received, an internal technical verification process will be initiated, which may require the collection of the item, subject to prior coordination with the customer. The result of the analysis will be communicated within a reasonable period of time and may result in: technical repair at no cost to the customer, replacement of the item with an equivalent one, or partial or total refund if repair or replacement is not feasible.
TWELFTH. APPLICABLE LEGISLATION AND JURISDICTION
This document is governed by the provisions of current Spanish legislation, and in particular: Royal Legislative Decree 1/2007, of 16 November. Royal Decree 1/2021, of 12 January. Directive (EU) 2019/771 on the sale of goods. For the resolution of any dispute arising from the interpretation or execution of this contract, both parties expressly submit to the Courts and Tribunals of the seller’s tax domicile, waiving any other jurisdiction that may apply.
